Travel Dynamo Mobile Terms and Conditions

Last updated:

These Mobile Terms and Conditions (“Terms”) are an agreement between you and Travel Dynamo, Inc. (“Travel Dynamo,” “we” or “us”) about the Travel Dynamo app for travelers and the services we provide through it (together, the “App”).

Please read Sections 13 to 15 carefully. They provide the App “as is,” limit our liability to US$100, even for our negligence, apply Texas law and the courts of Travis County, Texas, and waive jury trials and class actions.

In short

  • We make the software. Your agency arranges your trip and is responsible for it.
  • The App is free and for adults 18 or older.
  • Approving a plan does not book it. Your typed name is your electronic signature.
  • Your agency sees what you send and keeps it in its records.
  • Contact your agency first about your trip and your information. If that does not resolve it, write to support@traveldynamo.com, or to data@traveldynamo.com for privacy requests.
  • You can delete your account at any time in the App.

1. About these Terms

#

1.1 Accepting. By setting your password, signing in or using the App, you agree to these Terms. We may also ask you to accept them in the App. If you do not agree, do not use the App.

1.2 Your agency. “Your agency” means the travel agency, travel advisor or other travel business that gave you access to the App, and its staff.

1.3 Privacy. Our Mobile Privacy Policy at traveldynamo.com/mobile-privacy-policy explains how we handle personal information. Your trips, messages, forms and approvals are your agency’s records under its own privacy notice, and we handle them for your agency as its service provider.

2. Your account

#

2.1 Age. You must be 18 or older, and able to make a binding contract, to have an account. We may close an account that belongs to someone under 18.

2.2 Your agency controls access. You cannot sign up yourself. Your agency turns on your access, chooses which trips to share, and can turn your access off at any time.

2.3 Keep your account safe. Do not share your password. If you think someone has used your account, tell support@traveldynamo.com right away. We are not responsible for losses from use of your password before you tell us, unless we caused the misuse.

3. Your license to use the App

#

3.1 License. Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable and revocable license to use the App on devices you own or control, for your personal use.

3.2 Restrictions. You may not copy, modify, sell, distribute or sublicense the App, reverse engineer it except where the law allows this despite this restriction, or remove any notice in it. Open-source parts of the App have their own licenses. You may need the latest version to keep using the App.

4. Your agency, your travel and other services

#

4.1 We do not sell travel. Travel Dynamo provides software. It is not a travel agency, seller of travel or travel supplier, does not sell, book or pay for travel, and is not a party to any agreement between you and your agency or its suppliers. They sell and provide your travel, set its prices and terms, and are responsible for it. Your agency is independent and cannot make promises for us.

4.2 Payment services. If you pay your agency through a payment service, which may be provided by a Travel Dynamo affiliate or a third party, that service’s terms and privacy notice apply, and the company that provides it is responsible for it.

5. Trip information

#

5.1 Check important details. Trip details come from your agency and its suppliers. We do not check them or promise that they are accurate or current. Check important details, especially flight times and passport, visa, entry and health rules, with your agency, the supplier or the official source.

5.2 Copies on your phone. The App saves copies of your trips, messages and form drafts on your phone for offline use. They may be out of date. Signing out or deleting your account in the App removes them. Otherwise, they may stay until you remove the App.

5.3 Choosing or approving is not booking. Choosing an option, approving a plan or sending a form records your answer for your agency. It does not book, pay for, change or cancel anything. Deleting the App or your account does not cancel any booking.

5.4 Maps, notifications and emergencies. Maps show roughly where places are and are not for navigation. Notifications can arrive late or not at all. The App is not an emergency service. In an emergency, contact local emergency services.

6. Approvals and electronic signatures

#

6.1 Approvals. Your choices go to your agency, and other travelers on the trip may see them. You approve a plan by typing your full name while signed in. Choices, approvals and signatures sent from your account are treated as yours.

6.2 Electronic signature. When you type your name to approve a plan or sign a form, you adopt it as your signature, with the same effect as signing on paper. You agree to use electronic records and signatures under the federal E-SIGN Act and state electronic transaction laws.

6.3 Between you and your agency. Approvals and signatures are between you and your agency, not Travel Dynamo. We keep a record of each for your agency, including the name you typed, the time, your IP address and device details.

7. Forms, documents and messages

#

7.1 Accurate information. Give true, complete and current information, and only what a form asks for. The App saves your answers as you go, and your agency may see them before you send the form.

7.2 Acting for others. If you give information about someone else, or answer, approve or sign for them, such as for your child, you confirm that you have the authority to do so, for example as their parent or legal guardian or with their permission.

7.3 Passport reader. You can type passport details, or let the App read a photo of the passport page. If you use the reader, a third-party AI provider, such as Google, reads the printed details from the photo. AI can make mistakes, so check every detail. The photo is saved with your agency’s form.

7.4 Payment cards. The App does not collect cards. If a form asks for one, it opens on our website, where the card is stored encrypted for your agency, without its security code, and deleted 60 days after it was added or at the end of its expiry month, whichever comes first. We do not charge it. Never put card numbers or passwords in messages.

7.5 Messages. Messages you send go to your agency, whose staff can read and keep them. What your agency sends you comes from your agency, not from us. Your agency may use Travel Dynamo’s tools, including AI features, to work with your messages and answers.

8. Your content

#

8.1 Your content. You keep ownership of what you send through the App (“your content”), and you confirm that you have the right to send it. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, send and display your content to provide and secure our services for you and your agency, to comply with the law, and as Section 8.2 describes. The license ends when your content is deleted from our systems, except for copies we keep as our Mobile Privacy Policy describes.

8.2 De-identified data. We may create de-identified and aggregated data from information in our services and use it to operate, improve and develop them, including to improve and train Travel Dynamo’s own AI features. First we remove names, contact details and anything else that identifies a person or business. This data never includes passport or ID details, uploaded documents, card details, health information, message text or the other information our Mobile Privacy Policy excludes. We do not try to re-identify this data, we require anyone who receives it to commit in writing to do the same, and we do not sell it.

8.3 Feedback. We may use your ideas about the App freely.

9. Rules for using the App

#

You must not, and must not help anyone to: break the law or anyone’s rights; use another person’s account or let someone use yours; give false information; send anything unlawful, threatening, harassing, hateful or obscene, or harmful code; access records not shared with you, get around security or test it without our written permission; interfere with, overload or scrape the App; use it to build or train a competing product; or breach US export control or sanctions laws. We may remove content or limit access if we reasonably believe someone has broken this Section.

10. Our intellectual property

#

We and our licensors own the App, including its software, design and text. Travel Dynamo, Dyno and our logos are our trademarks. Your agency’s name and logo, and photos, maps and supplier content in the App, belong to their owners. To report copyright infringement, send a notice under the Digital Millennium Copyright Act to our Copyright Agent at support@traveldynamo.com, with the subject “Copyright notice,” or by mail to the address in Section 19. In appropriate circumstances, we close the accounts of repeat infringers.

11. Other companies’ services

#

The App relies on other companies for services such as cloud hosting, maps, notification delivery by Apple and Google, AI providers and photos. Websites and apps that the App opens, such as an airline’s check-in page or a map app, have their own terms and privacy policies, and we are not responsible for them.

12. Apple and Google

#

12.1 License agreement. These Terms are the App’s end user license agreement. If Apple’s standard Licensed Application End User License Agreement applies to your copy, it governs only your license to use the App on Apple devices, where the two conflict, and these Terms govern everything else, including Section 15.

12.2 Apple. If you got the App from Apple’s App Store: (a) these Terms are between you and Travel Dynamo, Inc. only, not Apple, and we, not Apple, are solely responsible for the App and its content; (b) your license is a non-transferable license to use the App on Apple-branded products you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions allow, including by other accounts through Family Sharing or volume purchasing; (c) we alone are responsible for maintenance and support, and Apple has no obligation to provide any; (d) we alone are responsible for any product warranty not effectively disclaimed, and if the App fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the fullest extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses from a failure to meet a warranty are our sole responsibility; (e) we, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection, privacy or similar claims; (f) we, not Apple, are solely responsible for investigating, defending, settling and discharging any third-party claim that the App or your possession or use of it infringes intellectual property rights; (g) you represent and warrant that you are not located in a country subject to a US government embargo or designated by the US government as “terrorist supporting,” and that you are not on any US government list of prohibited or restricted parties; (h) you must follow applicable third-party terms, such as your wireless data service agreement; (i) questions, complaints and claims go to us at the contact details in Section 19; and (j) Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, will have the right, and will be deemed to have accepted the right, to enforce them against you.

12.3 Google. If you got the App from Google Play, these Terms are between you and Travel Dynamo, Inc. only, and Google is not responsible for the App.

13. Disclaimers

#

In Sections 13 to 15, the “Travel Dynamo Parties” are Travel Dynamo, Inc., its affiliates, and their officers, directors, employees and agents, and claims relating to the App include claims about how we handle your information.

13.1 As is. We provide the App “as is” and “as available.” To the fullest extent permitted by law, the Travel Dynamo Parties disclaim all warranties, whether express, implied or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the App will be uninterrupted, error-free or secure, or that any information in it, including passport reader results, will be accurate.

13.2 Your travel. To the fullest extent permitted by law, the Travel Dynamo Parties are not responsible for any travel service, or for what your agency, its suppliers or other third parties do or fail to do.

14. Limitation of liability

#

14.1 No indirect damages. To the fullest extent permitted by law, the Travel Dynamo Parties will not be liable to you for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of trips, bookings, profits, data or goodwill, arising out of or relating to these Terms or the App, under any theory of liability, including negligence, even if told these damages were possible.

14.2 US$100 limit. To the fullest extent permitted by law, the total liability of all the Travel Dynamo Parties together, for all claims arising out of or relating to these Terms or the App, will not exceed US$100, even if a claim arises from the negligence of a Travel Dynamo Party.

14.3 Exceptions. These limits do not apply to liability for fraud, gross negligence or willful misconduct, or to liability that the law that applies to you does not allow to be limited.

15. Disputes

#

15.1 Notice first. A “Dispute” is any claim between you and a Travel Dynamo Party arising out of or relating to these Terms or the App. Before filing a claim, send us written notice at support@traveldynamo.com with the subject “Legal notice,” and we will write to the email address on your account before filing against you. Both sides will then try in good faith to resolve it for 30 days, unless a time limit would run out sooner.

15.2 Governing law. The laws of the State of Texas and applicable US federal law govern these Terms and every Dispute, without regard to conflict-of-laws rules.

15.3 Exclusive venue. Every Dispute must be brought only in the state courts located in Travis County, Texas, or in the United States District Court for the Western District of Texas, Austin Division. You and we consent to the personal jurisdiction of those courts and waive any objection to venue there, including that they are inconvenient.

15.4 Jury trial waiver. To the fullest extent permitted by law, you and we each knowingly and voluntarily waive any right to a trial by jury in any Dispute.

15.5 Individual claims only. To the fullest extent permitted by law, you and we may each bring a Dispute only on our own behalf, and not as a plaintiff or class member in any class, collective, consolidated or representative action.

15.6 Severability. If a court finds any part of this Section unenforceable for a Dispute, only that part is removed for that Dispute, and the rest of this Section, including the choice of courts, still applies.

16. Ending your use and deleting your account

#

16.1 Deleting your account. Removing the App does not delete your account. To delete it, go to Account and tap Delete my account. It is deleted right away, and your agency is told. If you cannot sign in, email data@traveldynamo.com from the address on your account, with your username and your agency’s name. If you ask us to delete your data, we delete it within 30 days, except what we must keep for legal, security or fraud reasons and backups that expire on their own schedule.

16.2 Your agency’s records. Your trips, forms, messages and approvals stay with your agency. To have them changed or deleted, contact your agency first, then data@traveldynamo.com if that does not resolve it.

16.3 Suspension. We may suspend, limit or close your account if we reasonably believe it is needed to protect the App, you or others, if you break these Terms, if the law requires it, or if your agency stops using Travel Dynamo.

16.4 What continues. Sections 4, 5.3, 6 to 8, 10, 12 and 13 to 18 continue after these Terms end.

17. Changes

#

We may change or stop offering the App or any feature. We may update these Terms by posting the updated version on this page with its date. For a material change, we will notify you by reasonable means before it takes effect, and we may ask you to accept it. Changes apply only going forward, and a Dispute that arose before a change is governed by the earlier version. If you keep using the App after an update takes effect, the updated Terms apply to you. If you do not agree, stop using the App and delete your account.

18. General terms

#

We may send you notices in the App or by email, and they meet any requirement that notices be in writing. You may not transfer these Terms. We may transfer them to an affiliate or to a business that takes over the App. These Terms are the whole agreement between you and us about the App and replace all earlier versions. If any part cannot be enforced where you live, it applies only as far as that law allows, and the rest stays in effect. Not enforcing a term is not a waiver. We are not responsible for failures caused by events beyond our reasonable control. No one else has rights under these Terms, except Apple under Section 12.2 and the Travel Dynamo Parties under Sections 13 to 15. The English version controls.
